WHAT IS CBD?
CBD a/k/a cannabidiol is a chemical found in the cannabis plant. Unlike its more famous cousin, THC (tetrahydrocannabinol), CBD is less robust. Consider it as a “body high, as opposed to a mind-altering high.” CBD is reminiscent of a “warm bath, melting the tension away.” Meanwhile, claims of CBD’s effectiveness are diverse as inflammation, pain, acne, anxiety, insomnia, depression, post-traumatic stress, and even cancer. This “new” miracle elixir with roots dating back to the first century B.C. has found professional disciples. The National Institutes of Health database lists 147 CBD programs for conditions as varied as infantile spasms and Parkinson’s disease. In June the FDA approved a cannabidiol-based drug called Epidiolex used for epilepsy. It was the first medical use for a CBD sanctioned product by the federal government. Preliminary research also showed that CBD is a useful antipsychotic for schizophrenia with fewer side effects compared to current drugs. The evidence is mounting that CBD is a reliable substance with clear and specific medical applications, even for opioid withdrawal. Whether CBD is legal to use remains dirty noise, as diverse as a hundred sounds at once. Nine states made cannabis legal for medicinal and recreational use. No matter hemp or marijuana, Alaska, California, Colorado, Maine, Massachusetts, Nevada, Oregon, Vermont, and Washington, said “yes” to its use. Still, the noise of whether CBD derived from hemp or marijuana has fractured commonsense. Most states confirmed that CBD derived from hemp is legal, while marijuana CBD is up for grabs. CBD use has skyrocketed in recent years, while state laws have become increasingly complicated. The most critical factor in determining CBD's legality is where did the plant come from-- hemp or marijuana. Even if hemp contains virtually no THC, there's still an open question: Is hemp oil legal? Yes and no! In most states, hemp is legal; including oils, edibles and lotions. Marijuana-derived CBD does not have the same plant-profile as hemp. In some states, CBD derived from marijuana is entirely legal; but in most states, its legality depends on many different factors and conditions. Arizona, Arkansas, Connecticut, Delaware, Florida, Hawaii, Illinois, Louisiana, Maryland, Michigan, Minnesota, Montana, New Hampshire, New Jersey, New Mexico, New York, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, and West Virginia approved cannabis for medical use. While Alabama, Georgia, Indiana, Iowa, Kentucky, Mississippi, Missouri, North Carolina, South Carolina, Tennessee, Texas, Utah, Virginia, Wyoming, and Wisconsin allowed cannabis only as CBD oil with restrictions on THC content.
It would be safe to say --- hemp derived CBD in legal nationwide, while marijuana-derived CBD is illegal. The holdouts are Idaho, Kansas, Nebraska, and South Dakota. Meanwhile, the DEA’s mission is to prosecute large-scale drug traffickers, not individual users. As with all cannabis products, the federal government categorizes CBD other than Epidiplex as a Schedule I drug, like heroin. CBD is illegal under federal law, even in states that have legalized its use, whether medical or recreational. A public company must think twice before entering the CBD market without a federal mandate. Many larger corporations have not made direct acquisitions and taken small positions in companies with a “toehold” in the CBD field. CBD is everywhere. CBD infused foods, beverages, jars of honey, cosmetics as blemish creams, sleeping masks, shampoos, hair conditioners, eye serums, anti-acne lotions, mascaras, massage oils, soaps, lip balms, bath bombs, anti-wrinkle scrums, muscle rubs and hundreds of put on and put in applications. Whether such uses are beneficial may never be known. There is no evidence that minimal amounts of CBD work. An example: CBD infused cup of coffee may have five milligrams in it.
